To Mandate Easy Exit Safety Features on Buses!

How Many More Innocent People Must Needlessly Die?


The tragic and unnecessary injuries and multiple deaths of innocent students and adults when a Federal Express Truck collided head on with a school bus in Orland, California on April 10, 2014 could possibly have been minimized or even eliminated had better safety features been federally mandated.

Quoting from an article published in The Republic, Rules To Make Crashed Buses Easier to Escape Still Not Adopted 15 Years After Recommendation,  “Because the bus was overturned and partially submerged, passengers had to evacuate by standing on the seats, pushing up on the emergency windows, and climbing out onto the top of the bus.  Each of the emergency windows on the bus was hinged at the top, allowing the window to swing open when the emergency release bar was activated.  Tests performed by the manufacturer after the accident indicated that an upward force of 85 pounds was needed to fully open an emergency exit window with the coach lying on its side.”

Due to the height of some of the passengers or the window weight, some people were unable to push the windows open after unlatching them.

The Secretary of Transportation Anthony Foxx has the power, and therefore must, issue new standards for large buses so that after an accident passengers can easily open windows and emergency exits.

Can you even imagine the fear and desperation that these people felt ?  The New York Times headline said it best: “In An Instant, a Bus to College Was A Fiery Trap.”

Per the National Highway Traffic Safety Administration, easy-to-open windows and exits are necessary “to ensure evacuation in adequate time under different emergency situations for various occupant groups, including children and the elderly.”

9 Killed in Crash Between Fed Ex Truck and Bus Carrying Students

Chico, California: A FedEx truck collided head on into a bus on Thursday, April 10 when it allegedly crossed the center divider on the I-5 Freeway in the city of Orland (Glenn County, Ca) killing nine people and injuring dozens more.  Orland is approximately 100 miles north of Sacramento.

If the allegations are correct, FedEx will undoubtedly be held liable for the injuries to those who survived and the families of those who so tragically and needlessly died in this accident. Among the dead were the drivers of the FedEx truck and the charter bus.

The charter bus company could be held liable as well if it can be shown that its driver could have avoided the accident and/or contributed in some way to the crash through his own comparative negligence or inattention.

Could distracted driving have been one of the root causes of this tragedy?

Motorcycle Safety Videos: One Graphic, One Tame

zero accident sceneScotts Valley, California: 71-year old Alan Yelensky died earlier this week while riding his 2014 Zero All-Electric Motorcycle south on Granite Creek Road near Blair Ranch Road south of Scotts Valley.  Yelensky collided with a northbound Ford F-250 truck.  Yelensky was ejected from his motorcycle and landed about 15 feet down an embankment.

This story caught my eye and my heart because here a man lived 71 years to have his life snuffed out in a nanosecond.  I represent people who have been injured on motorcycles and the families of those who have died in motorcycle crashes.  Nothing can be more devastating than to have your life, or your family’s lives, changed for the worse in a split second.  A wrongful death lawsuit is something that no one ever wants to be a party to.  I know, I’ve handled way too many wrongful death lawsuits.

Text, Drive and Kill: Go To Jail

I'm burning mad. It takes a moment to pull over to read or respond to a text, to program your GPS, to dial the phone (should you not have voice command) yet people do it while their car is moving.  And, more importantly, while other cars, bicyclists, pedestrians, cats and dogs are moving.  And while buildings are stationary.  Taking our eyes off the road seems harmless enough but it can cause injury and death.


In New Hampshire, 18 year old Aaron Deveau was sentenced to jail for vehicular manslaughter.  He was convicted of causing an accident which never, ever would have happened had he been watching the road.  Instead, he was texting his girlfriend. Now an innocent 55 year old grandfather has been taken from his family. His girlfriend was critically injured.  And Aaron will spend, at most, one year in jail.  And, oh yeah, his driver's license will be suspended for 15 years.

This is unconscionable.  This must stop. 

Write to your legislators and tell them NO MORE (US House of Reprentatives).

Warning! Refinishing Your Bathtub Could Kill You

Bathtub refinishing 002    How scary is this?  Beautifying your bathtub could lead to death.

    It turns out that 13 bathtub refinishers have died in the last 12 years as a result of methylene chloride stripping agents.  According to an article in Health Day, "All of the deaths occurred in residential bathrooms with inadequate ventilation. The victims either did not use protective respiratory equipment or the equipment they used did not protect against methylene chloride vapor, according to the report in the Feb. 24 edition of the Morbidity and Mortality Weekly Report, published by the CDC."

Failure to Warn

    Here's the problem: According to the Health Day article, "Ten different products were associated with the deaths, with six marketed for use in the aircraft industry and the others for use on wood, metal, glass and masonry. Bathtub refinishing was not mentioned on any of the product labels."

Warning sign 003    So, if the bathtub refinishers didn't know that the product posed a danger, how could they have prevented their own demise?  Bottom line is this: A manufacturer has a duty to properly label their products and to warn potential users victims of the known dangers.  How simple would it have been to just say "Warning: Must Be Used in a Well-Ventilated Area"?

    This is potentially a huge products liability problem for the manufacturers, distributors, wholesalers and retailers of these products.  The bathtub refinishers have left behind families who may have the right to compensation for the loss of their loved one.
