What is product liability? It is the legal responsibility that companies have if they fall within the "chain of commerce" for a defective product that has injured someone.
The "chain of commerce" is is basically anyone who has profited from placing the defective product into the marketplace. Generally speaking, "chain of commerce" includes manufacturers, wholesalers, component part makers and suppliers, distributors and sellers including the supermarket, department store or internet site where you bought the item
Some dangerous or defective products are improperly designed or engineered. Other products have manufacturing defects leading to dangerous or defective products. When you are injured while using a product in the manner in which it was intended to be used, the manufacturer and others in the "chain of commerce" must be held responsible.
A product may be dangerous or defective if it lacks adequate warnings or instructions.
What types of items can fall into the category of a defective product? Just about any item that causes you harm may be considered a defective product. Examples of defective products that can be the subject of a product liability claim are virtually limitless:
